undefinedThe slogan “Slow Down, Move Over” isn’t just a reminder—it’s the law.

In California, fines are doubled in work zones, and many drivers in Santa Barbara County learn that the hard way.

Highway 101, especially through Summerland and Carpinteria, has seen constant construction for years. Those familiar orange cones aren’t just a sign of progress—they’re also prime spots for speeding tickets.

Understanding “Slow Down, Move Over”

The “Slow Down, Move Over” law protects emergency personnel, construction workers, and roadside crews. When drivers see flashing lights or work vehicles, they must safely move over a lane. If that’s not possible, they must slow to a safe speed and proceed cautiously.

Ignoring this rule could lead to a speeding ticket—and when fines are doubled in work zones, the cost can skyrocket quickly. Not to mention a significant rise in the driver’s already expensive insurance premiums.

California Vehicle Code Sections That Apply

Two common codes appear on work zone citations: CA Vehicle Code (VC) Section 22350 and Section 22362.

CA VC 22350, which is the CA “basic speed law,” states that:

“No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.”

CA VC 22362 specifically covers work zones. It prohibits driving faster than posted limits where workers are present. Signs must be clearly posted at each end of the construction area, typically not less than 25 mph.

Violating either section can lead to expensive penalties. Along Highway 101 in Santa Barbara County, enforcement and tickets are frequent.

Common Work Zone Ticket Locations

In Santa Barbara County, law enforcement often monitors construction zones near Summerland and Carpinteria. Santa Claus Lane, a beachfront street located near Carpinteria, known for its Christmas-themed stores, is a favorite area for CHP RADAR and LIDAR set ups.

Tickets often cite VC Sections 22349(a) or 22350, but occasionally officers use Section 22362 instead, which is appropriate in a work zone. Even if the wrong code is listed, that alone will not guarantee dismissal. But making the right objection or argument at the right time goes a long way toward getting a good result!

Section 22362 covers speeding within 400 feet of a work zone that is specifically posted.

“This section applies only when appropriate signs, indicating the limits of the restricted zone and the speed limit applicable therein, are placed by such agency within 400 feet of each end of such zone

The signs shall display the figures indicating the applicable limit, which shall not be less than 25 miles per hour, and shall indicate the purpose of the speed restriction. Nothing in this section shall be deemed to relieve any operator of a vehicle from complying with the basic speed law.”

Once again, the basic speed law states “a speed greater than is reasonable or prudent.”

When these conditions were not present, it is crucial to consult a speeding ticket attorney familiar with the traffic code and the local courts. It could make all the difference.

Why Fines Are Doubled in Work Zones

California law doubles fines for speeding tickets in construction areas to protect workers at risk from speeding drivers. The increased fine serves as a deterrent, reminding motorists to slow down and stay alert.

It’s not just about money—it’s about safety. A single mistake in a work zone could endanger both you and those maintaining the roadways.

How a Speeding Ticket Attorney Can Help

A traffic attorney can challenge the radar device’s accuracy, question the placement of signs, or negotiate reduced penalties. Were there signs posted and workers present?

Many drivers don’t realize how complex a speeding ticket defense can be until they’re standing before a judge.

Hiring a legal professional can mean the difference between paying double fines and keeping your record clean.
