undefinedCA Vehicle Code (CVC) 22348, Speed Laws prohibits any driver from speeding 100+ mph on any highway or freeway in CA. Paragraph (b) states, “A person who drives a vehicle upon a highway at a speed greater than 100 miles per hour is guilty of an infraction punishable by…”

Although paragraph (b) (1) goes on to say, “…a fine of not to exceed five hundred dollars ($500).” That figure is the base fine and does not include the ten surcharges, fees, and penalties added by the CA legislature and governor since that bill became law.

The state assessment adds $10 for every $10 of the base fine, which doubles it. Then, a 20% percent state surcharge, the county assessment, $7 for every $10, the DNA research fund, $4 for each $10 of base fine, the court construction expense of $5 for each $10. Add the Emergency Service assessments, the Air Transport emergency fund, a conviction assessment, the court operations surcharge, and a night court fee, regardless if you use night court.

A speeding 100+ mph speeding ticket conviction can be very costly. The fine alone can be $900 to $2,500. Another expense involved with a speeding 100+ ticket is the mandatory court appearance. If you get caught in Barstow, on your way to Vegas from LA, you will have to come back for the arraignment, and possibly another date for the trial unless you hire a traffic attorney. Since this is likely the most expensive traffic ticket you will ever receive if you are convicted, you really have no choice but to hire an attorney.

You could very easily spend $10,000 you had not planned to pay if you get convicted of speeding 100+ mph. The fine is minor when you consider how much your auto insurance premium will increase. At your next renewal, your insurance company will find out you were convicted of speeding 100+, and they could double or triple your rate if they retain you as a client.

You could save a lot by getting an old car you don’t need full coverage for, but you could save a lot more by hiring a traffic attorney experienced with 100+ mph speeding tickets. Bigger & Harman has that experience.

But That’s Not All

What’s more, they can handle every facet of your case and call you when it’s over. You won’t have to worry about driving back to Barstow, sitting through the wait for your case to get called, and explaining to the judge why you were not guilty of speeding 100+ mph.

If you need two more reasons to hire a traffic attorney, there is a 30-day driver’s license suspension at the judge’s discretion, for one. And the two negligent operator treatment system (NOTS) points assessed by the DMV if you are convicted puts you halfway to a six-month suspension and 12 months’ probation. That conviction will remain on your driving record for seven years, and your premium will remain high until it is removed.
