Too Close For ComfortWith over 19,000 big rigs traveling the I-5 over the Grapevine each day, the highway can get a little too crowded to observe the normal three second following rule recommended by the DMV. You will oftentimes see a big rig burning up its brakes while following another truck because it’s not safe to change lanes and go around the other truck. Here’s the language of VC 21703, the law prohibiting following too closely:

The driver of a motor vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of such vehicle and the traffic upon, and the condition of, the roadway.

Under this code section, there is no specific distance that you are required to maintain between you and the vehicle in front of you. However, you should understand that even though it’s not reasonable sometimes, the CHP will occasionally cite for following less than three hundred feet behind or for failing to follow the three second rule.

Truckers usually have their citations sent to the Lamont or Santa Clarita courts when the alleged violations occurs on the Grapevine. Traffic laws are heavily enforced in the area and there is a low tolerance for technical violations of the law. If you are driving a big rig, you should also be aware that Vehicle Code 21704 prohibits big rigs from following within 300 feet, an entire football field, behind another big rig when you have a single lane designated for travel in that direction. Vehicle Code 21705 also applies to following distances in caravans, but should be used carefully in consideration of VC 21704.

Unfortunately, a violation for following too closely can have serious consequences, including 1.5 points on your MVR. Contact us today for a free consultation.
