It may be possible to talk your way out of a traffic ticket in Inyo County,
but not in the way you may expect.
Your opportunity starts as soon as you see the flashing lights in the rearview
mirror. Especially because of a few recent high-profile incidents, many
officers are very nervous when they pull over a vehicle. Essentially,
you can defuse that situation, or you can make it worse:
Do: Pull over promptly (or at least turn on your hazards immediately), keep
your hands on the wheel at 11 and 1, roll down the window, turn on the
dome light, and remain motionless.
Don’t: Make any sudden moves. It’s natural to go through your purse or
pocket to find your drivers’ license and insurance and have them
ready, but don’t do that. Wheeling around to the back seat is an
Most officers are trained to have a conversation with drivers. At some
point, the officer typically asks an open-ended question, like “do
you know why I pulled you over?” or “is there a reason you
were speeding?” This is your next opportunity.
But do not make excuses or try to litigate the case on the street. Officers
have heard all the excuses there are, and they do not like to stay on
the street any longer than necessary. Be friendly, noncommittal regarding
your speed, promise the officer that you will keep your speed down and
ask if you can get a warning this time. If you have a valid reason for
hurrying a little bit, go ahead and share it, but make sure you say it
in a way that does not indicate you are entitled to a break. You are asking
for mercy, not demanding it.
Of course, this approach doesn’t always work. In fact, your chances
of success are rather slim. While there is an excellent chance that you
have a good excuse, let an attorney present your case to the judge. That’s
what I’m here for.
